This website is operated by Avaleira ("Avaleira," "we," "us," or "our"). Throughout the site, the terms "you" and "your" refer to you, the user or customer. By visiting avaleira.com (the "Site") and/or purchasing from us, you agree to be bound by these Terms of Service ("Terms"), including any additional policies referenced here, such as our Refund Policy and Privacy Policy.

Please read these Terms carefully. If you do not agree to all of them, you should not use the Site or place an order.

We may update these Terms from time to time (see Changes to These Terms below). Your continued use of the Site after changes are posted means you accept the updated Terms.

2. Eligibility

By using this Site and placing an order, you confirm that:

• You are at least 18 years old, or the age of majority in your US state of residence, or that you are using the Site with the consent and supervision of a parent or legal guardian.
• You are a resident of, and your order will be shipped to, the United States. We currently sell and ship to US addresses only.
• The information you provide to us is accurate and complete.

3. Sales territory and shipping

We sell exclusively to customers within the United States and ship only to US shipping addresses. Orders requesting delivery outside the United States may be canceled.

Our products are fulfilled through third-party suppliers and fulfillment partners. As a result:

• Delivery time frames are estimates, not guarantees, and may vary based on the fulfillment partner, carrier, and destination.
• Items in a single order may ship separately or arrive at different times.
• Risk of loss and title for items pass to you upon delivery to the carrier.

4. Products, pricing, and availability

• All prices are listed and charged in US Dollars (USD).
• We make every effort to display products and prices accurately, but errors may occur. Colors and details may also appear differently depending on your screen.
• We reserve the right to correct any errors, inaccuracies, or omissions, and to change product descriptions, pricing, and availability at any time without prior notice.
• Product availability is not guaranteed, and we may limit quantities or discontinue any product at any time.
• We reserve the right to refuse or cancel any order, including orders that appear to be placed by dealers, resellers, or distributors, or that we suspect to be fraudulent.

5. Orders and payment

When you place an order, you are making an offer to purchase. We may accept or decline that offer. An order is not confirmed until we send you an order confirmation, and acceptance occurs only when the item is shipped.

You agree to provide current, complete, and accurate purchase and account information. You are responsible for any applicable taxes associated with your purchase as determined at checkout.

If we cancel an order after payment has been processed, we will issue a refund to your original payment method.

6. Returns and refunds

7. Health, wellness, and product use disclaimer

The Avaleira Heating Pad and any similar products we sell are general consumer wellness and comfort devices. They are intended only for personal comfort use, such as applying gentle warmth and massage.

Our products are not medical devices. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition, including but not limited to menstrual disorders or chronic pain. Nothing on this Site is medical advice.

Before using our products, and before relying on them for any health-related reason, you should consult a qualified healthcare professional. If you are pregnant, have a medical condition, have impaired heat sensitivity, use an implanted medical device, or have any concern about whether a product is safe for you, seek medical advice first.

You agree to use all products strictly in accordance with the instructions, warnings, and safety information included with the product, including instructions regarding electrical safety, charging, heat settings, and duration of use. You assume all risk associated with misuse or use contrary to those instructions.

8. Intellectual property

All content on this Site — including text, graphics, logos, images, product descriptions, and the Avaleira name — is owned by or licensed to us and is protected by applicable intellectual property laws. You may not copy, reproduce, republish, or exploit any part of the Site for commercial purposes without our prior written permission.

9. Customer submissions

If you submit reviews, comments, photos, or other content to us or the Site, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with our business. You are responsible for ensuring your submissions are accurate, lawful, and do not violate any third party's rights. We may, but are not obligated to, monitor or remove content at our discretion.

To the maximum extent permitted by law, Avaleira and its owners, suppliers, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use or inability to use the Site or products. Where liability cannot be excluded, our total liability to you will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.

You agree to indemnify and hold harmless Avaleira and its owners and partners from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your violation of any law or the rights of a third party.

15. Changes to the Site and these Terms

We reserve the right to modify or discontinue the Site or any product at any time without notice. We also reserve the right to update these Terms at any time by posting the revised version on this page with a new "Last updated" date. It is your responsibility to review these Terms periodically.

16. Governing law and disputes

These Terms and any separate agreements are governed by and construed in accordance with the laws of Norway, without regard to conflict-of-law principles. Avaleira is operated as a Norwegian sole proprietorship (enkeltpersonforetak), and any disputes that are not otherwise resolved will be subject to the jurisdiction of the Norwegian courts.

Nothing in this section removes or limits any mandatory consumer protection rights you may have under the laws of your place of residence in the United States. Where such mandatory protections apply, they continue to apply regardless of the governing law stated above.
